Dear All,

MoEF, industrial committee  has granted Terms of reference for our project.

As per TOR,

1. CRZ map to be prepared by the authorized agency of MoEF by demarcating our project boundaries.

2. CRZ clearance / recommendations from state coastal zone management authority

As per the TOR granted by MoEF, we have carried out the CRZ mapping with MoEF authorized agency. As per the map, our project is outside CRZ area.

My Question is : if our facility is out of CRZ area also, we need a CRZ clearance / recommendations from state coastal zone management authority?

or

Can we say Industrial committee that we are out of CRZ area as per the map prepared by MOEF authorized agency, so CRZ clearance from sate coastal zone management authority is not applicable.

Kindly guide the same

YES, you have to get it vetted by state authority as they are sole authority to decide the boundary.

First, authorized agency should be very good, best is NIO though their charge is very high. MoEF will not question NIO clearance. Other wise please take in writing from auth.agency that area is clearly out of CRZ. It will save time if PP could manage to get certification from SCZMA that project is outside CRZ. 

It is simple logic. MoEF committee wanted to know the status of the site, whether it falls within crz limit. Your application for out-of-crz-limit must be submitted to SCRZA. In my opinion it is adequate to submit the map land superimposed with CRZ map to issue a no-crz certificate. They may also argue that they have authority only over crz area and avoid taking a decision. To avoid this situation you may submit the application with all formalities. SCRZA will be naturally bound to give their decision which will suffice your purpose

I am going through the CRZ notification. As per the notification, state CRZ committee can only give the recommendations. We need to submit this recommendations  to center CRZ committed to get the CRZ clearance certificate.

In the CRZ notification, no where it is written that, if project boundaries is out side CRZ also need to be vetted with state CRZ committee.

If our area is out of CRZ, why do we need to go through this procedure?

Can we defend our self and inform industrial committee that CRZ is not applicable to us as per the map prepared by authorized agency.

Dear, 

I agreed.

Please try to understand that mapping authority (MOEF authorized agency) is not competent to certify CRZ status of your project. You need to get recommendation from SCZMA.

So, please submit Form I with MAP to SCZMA. Let them declare your CRZ status as minutes.

Then you may proceed to MoEF with SCZMA recommendation.

I agree with Saurav

The District level CZMA first takes up this and recommends to the SCZMA. This is when the project site or any of the project activity falls under CRZ area. (pipe laying etc). Directorate of Town and Country Planning here in Tamil Nadu certifies whether the site is outside the CRZ area. You may try this in your state with the relevant department - Planning authority, for the survey nos involved.
