Respected all,

This is to seek advice on requirement of consents from state pollution control board for setting up of solar power plant of < 5MW,for use of  elect in own grid. Are such project require to get "consent to establishment" or "consent to operate"or any amendment require in consents for such projects? Is there any policy, where such projects exempts from NOC or CCA? Also, is it require to get EC or CRZ clearance? Kind request to have views with support of Gov.policy/rules,if any..thanks in advance..

State Pollution Control Board issues consent to establish provided the effluent and emission from a proposed establishment meet the prescribed standards. If there is no effluent and no emission, there is no need to seek such consent.

iF THE Project is alarge one for the following reasons The Operator have to obtain the consent.

i)If the area where the Plant is put up if declaraed as Air pollution Control area.It is obligatory to seek consent to oerate the facility in Air pollution control area.

Consent is also require to discharge Sewage also.normally generated form the conviniences provided for thee bebefit of employees.

Morethan that the the facility will generate ELECTRICAL WASTE DURING OPERATION PHASE which are classified as hazardous waste under E WASTE.for which authorisation is required.By getting consent nothing u will lose it will put u in alert to fulfill the legal requirements.

Dear you have to require consent to establish (for water and air),

whereas consent to operate only under water Act. as there is no Air pollution in operation phase.

i have been involve in more than 10 solar projects in rajasthan

Solar power plants comes under green category as per the ind categories and if it is in CRZ area i think you have to take CRZ clearance plz Chek with CRZ Authority...EC is not required for this.

AS per  CTE (consent to establish) conditions you have to submit reports related to Biodiversity & Socioeconomic studies (We have conducted these studies for 20 projects and submitted to PCB's for obtaining Consent to operate). for your project following conditions are applicable

1. That the office memorandum issued by MOEF vide letter no 1-11013/41/2006-1A.II(I) dtd 30.6.11 should be followed in letter and spirit as its applicability in relation to all projects falling under 8(b) of the EIA notification dtd 14.9.06 is justified in terms of the total land area acquired by any kind of project falling under wet land; agricultural land ; ecologically sensitive areas and also the loss of biodiversity, vegetation, displacement of habitation etc in reference to the same.

2. That the unit shall conduct Environment Impact Assessment Studies through a recognized firm with particular reference to the flora, fauna and endangered species and the impact of the project on the biodiversity and ecological balance of the area and prepare an Environment Management Plan(EMP) accordingly also including relief and rehabilitation of displaced persons and corporate social responsibility and submit the same to the State Board within a period of two months and till then no work for the installation/ construction of solar plant shall commission at site to facilitate the conduction of Environment Impact Assessment studies .

Thanks to all,kindly take note that the proposed land does not fall under CRZ-I-i, does not fall under category as described in order of MoEF as Yati sir explained. so, i think it does not require EC and CRZ clearance. NOw, the project does not involve any air and/or water pollution during operation/construction phase. The generated power will be used/feed in own grid. There is no pollution potential at all. BUt, there is no such order or policy, which clearly shows exemption from CTE/CCA. Inviting expert views.thanks in advance...

Consent is a defferent from  EC .EC is required for the sectors listed in the EIA Notification,where as consent is required for allthe facility.No activity is exempted from the perview of the Water and Air Acts for getting consent unless the respective Board notified.Pl check up with the local SPCB.

Hi,

Any new installation / unit / production plant either in existing utility or manufacturing needs consent. For this PCB procedure will have to be followed.
