Env clearence validity for Infrastructure and Miscellaneous Projects & CRZ

Can anyone clarify me that in case of Infrastructure and Miscellaneous Projects, Env clearence validity is 5 yrs. is it necessary for proponent to complete the project for which the conditional EC granted in 5 yrs or if any PP starts construction & expend money as commited in EMP for env cost is enough to avoid extension of Env clearence validity ?? I observed two kind of things in this regard:

"When asking from EAC officials of Infrastructure and Miscellaneous Projects, MoEF, they said: The PP does not necessariarily have to complete all construction activities within validity period of granted EC. Further, Section 9 of EIA Notification 2006, says......

9. Validity of Environmental Clearance (EC):

However, in the case of Area Development projects and Townships [item 8(b)], the validity period shall be limited only to such activities as may be the responsibility of the applicant as a developer.

It seems supporting to statement of EAC officials of Infrastructure and Miscellaneous Projects, MoEF as my view.

Meanwhile, most of the consultant saying : PP have to necessarily complete all its work for which conditional EC has been granted otherwise they have to go for extension of EC from competent authorities.

 

Hence, after considering both kind of views i am still not clear about validity of EC for construction, township & area development project. Comments are invited to clarify this subject.

The validity of EC is 5 years in case of Infra projects unless any thing specified in your EC letter in regard to this. This validity is to start the construction activity. however there is  a confusion due to some Goa bench order on validity reg a mining project due to the wording in EIA notification. It is  5 year to your project to start construction. In case of township construction project the responsibility of developer ends after the project is built and handed over to the society for running day to day basis.

I agree with Uday Bhaskar's views

EIA notification 2006 states "The Area Development projects and Townships [item 8(b)] projects, the validity period shall be limited only to such activities as may be the responsibility of the applicant as a developer" Here the responsiblity of the developer to coplete the projects within the stipulated time & handovered to end users.
