As told in previous mails , ( My factory is new green field  factory , under construction and We have a Valid consent for Establishment ( COE) .
Please support with answer for the following queries .


1. When an industry can apply for hazardous waste authorisation ?

2. When an industry can get Hazardous waste authorisation ( Time frame between application and authorisation ) ?

3. Is there any linkage between Consent for operation and Hazardous waste authorisation

4. And Whether its possible to  get hazardous waste authorisation before getting Consent for operation..

I want do everything very perfectly in the right way ( 100 % Compliance with legal requirement )

there is no fixed time frame for getting consent.. it may take from 4 to 6 months.

Yes. there is a linkage between hazardous application and Consent to operate. You have to submit Hazardous waste authorization with consent to operate, without HWM authorization application, Consent to operate will not be granted ( If ur industry is falling under hazardous waste generation category or producing Hazardous waste)

no, usually, hazardous waste authorization is granted with COnsent to operate. so you canot get it before.

1. Industry can apply by filling Form 1 of Hazardous Waste (MHTB) Rules 2008 when industry is generating Hazardous waste as per Schedule I, II, III, V-A or V-B.
Either before starting the plant that is getting Consent to Establish or for Consent to Operate.

2. CFE along with authorisation will be issued by SPCB within 60 days from the application submission.
and For CFO along with aurthorisation will be issued within 60 to 90 days if there is no discrepancies in apllication.
3. Consent to Operate or Consent to Establish is as per Air Act 1981 and Water (PCP) Act and authorsiation is as per Hazardous Waste (MHTB) Rules 2008 under Envi Protection Act 1986.
4. Yes you can get it authoirastion along with CFE.

Dear Rajesh,

1. If you generate hazardous wastes as listed in the Schedule - I of Hazardous Wastes (Management, Handling and Transboundary Movement) Rules, 2008 and subsequent amendments; you are liable to obtain Authorization under the same rule. Practially, almost all projects during construction phase also generate hazardous wastes as listed in Schedule - I.

2. Time frame depends entirely upon the SPCB or PCC. However, if application is complete in all respect, you may be accorded authorization within 4 months.

3. There is a linkage between consent and authorization, in the way that operations from most of the factories or establishments generate HW.

4. Yes, you can.

 

But, most importantly, please do consult your local SPCB and PCC also.

Dear Rajeshbhai,
pl refere the HW Rules, 2008 (1) it is clear in defination of "authorisation" that authorisation means permission for generation...so you should possesse the authorisation before generation of HW. (2) As per Rule 5 (4), SPCB should decide the authorisation within 120 days from the date of application. (3 & 4) As SPCB in the Gujarat State has adopted common consents and authorisation (CC&A) concept, you have to apply for consents to operate in Water Act, Air Act and authorisation all together (if you plant is located within Gujarat).

I am agree with Rajesh Sir, We are producing hazardous waste during construction phase also. please refer the Hazardous Waste Management handling Transboundry movement Rules 2008 Schedules. As per my knowledge no one is taking hazardous waste authorization during construction phase. Some SPCB time for application is six month, Two month, one month depends on that state pollution control board. Now a days every where facility of CHWTSDF is available for safe disposal. In some state we have to apply seperately for Hazardous waste authorization while many SPCb combine authorization in consent to operate.

only COE getting is not important but during operational and post operational management is necessary for proper environmental management methodologies

Dear Rajesh,

Even during construction phase,the project activity would generate haz waste such as Paint residue,containers,broken lights containing mercury,(from labour quarters) etc.Legally speaking the authorisation is required for construction phase also for the generation ,collection,storage and disposal.The authorisation is further required during operation phase along with the consent to operate.the time frame to get the authorisation normally one month.How ever u have to check with local SPCB.

There must be a point mentioned in the COE on this matter.

You can apply for HWA after getting the COE and before commissioning of your industry.

Generally took around 3-4 months. But it depends on the PCB. They will make a visit to your site to inspect and reaffirm the facilities mentioned in your application. After this PCB will give u the authorization.

1. If U (Industry) are generating Haz. waste (as per MSIHC, 1989), then u hav to for authorisation. for more details contact concern PCB.
