What is meant the validity of Environmental Clearence as per the Clause -9 of Notification 14th sep. 2006. As per my quarry and discussion, The PP Should have start the project with in the validity period, it is not meant that the project completes with in a stipulated period of 05 - years. it means if you have started the project with in validity period so one can not require any extension for another 05 years because we already expand on EMP of that particular Project, Kindly highlight the issue and discuss it, because if you ask the consultant about the same then they instantly say yes, you required that

Dear,

Validity of environmental Clearance meant "the period from which EC is granted by regulatory authority to the start of the production operation by the project or activity" (Case of all industrial projects)

Or

Completion of all construction operation in case of construction projects ( Case of building & township projects), However in case of area development projects this period is limited only to such activities as may be responsiblity of the applicant as adeveloper.

Thanks for your reply but still to clarify that in our case we are realestate developer, we develop G.H - Construction & Residential Township Project than in our case once we started the project the validity of E.C remains till we finish the project either it will take 5 years or 10 years etc. kindly elaborate these aspects Please, Thanks for all

The validity means the period from date of Issue oF EC to start of production when such things not happened renewal may be applied.

Dear,

For building construction & Township projects you need to finish your work with in the valadity period i e. Five years,In case if it could not happen within 5 years approach to concerned authorities for renewal of EC for next five years before expiery of valadity period. Follow the procedure as mentioned in clause 9 of EIA notification, 2006.

Pl. note that renewal or non renewal of EC is subjected to EAC/SEAC decision after going to detail   discussion on project & changes occured in physical biological, social aspects of the area, in few cases i have seen that even applying within the valadity period SEACs has asked  to proponent for fresh EIA study & appraisal due to changes with in area.

Wanted to clarify, if the project is not completed and construction is going on and we apply for renewal and the validity expires before the project is not granted renewal, does it mean that the construction of project has to be stopped, till the time renewal is granted?
