STANDARD TERMS OF REFERENCE (T.O.R.) FOR E.I.A./E.M.P. REPORT FOR PROJECTS/ACTIVITIES REQUIRING ENVIRONMENT CLEARANCE UNDER E.I.A. NOTIFICATION, 2006

 

There has been total lack of objectivity as far as environmental clearance of projects/activities is concerned. Each state (SEIAA/SEAC) has there own procedures and requirements (whims and fancies, to say) which lack logical comprehension.

The consulting professionals, mostly governed by the vested interests or to avoid "contempt", rarely confront with the people on other side of the table. The singular agenda is getting the "clearance" and not "prudent environmentalism".

The Ministry has taken one small right step in standardising the TOR.

It remains to be seen as to what extent it is able to rationalise process of the "clearance".

I would like have clarifications on the following two points

1) This procedure will be applied only 30 days after notification. Is it notified or yet to notify
2) As per MOEF notification dated 22nd Aug 2013 - all projects and activities listed as Category B in item 8 of the Schedule (Construction or Townships or Commercial complexes or Housing) does not require scoping and should be assessed based on Form 1, Form 1A and conceptual plan.

but where as in standard TOR their are 23 points given under this sector.

Even now many SEAC/SEIAA committees are giving TOR and following the MOEF notification dated 22nd Aug 2013.

As you said no consultant is confronting the SEAC committee.

I feel the notification is yet to come.

Reg. category 8 projects, B1 category (builtup area >150000 m2, etc.) needs comprehensive eia as per the tor.
