provision of pollution control measures under Env.laws

Generally, the industries are directed to provide ETP or STP or Air pollution control device or any pollution control equipments, based on type of industry and generation of effluent/sewage or etc.

Just wanted to know, under which provision/section of the environment laws/rules  prescribed all these.Which Env.rules or laws ask that the industry has to set up ETP or STp or APCD?

EPA rules prescribes pollution standards.generally, it is mentioned in Consent or authorisation granted by the state pollution control board that the industry has to comply and to set up pollution control equipment/structures.BUt, under which provision, the SPCB can direct the industry?

Air Pollution under "Air pollution Prevention & Control of pollution act 1982" Water Pollution under "Water Pollution Prevention & Control of pollution Act 1974.

OF course, it is under Water/air laws, but just go through it, nowhere it is mentioned that industry has to set up such facility.

Industries are asked to setup pollution control measures in consent to establish or consent to operate conditions given by SPCB or EC conditions given by Ministry.

And this comes under Air pollution Prevention & Control of pollution act 1982" Water Pollution under "Water Pollution Prevention & Control of pollution Act 1974.

The provisions to ask industries to set up treatment facilities are already there Water Act, Air Act, EP Act, HAz Rules ....

  • Water Act & Air Act includes Rule 17, Functions of the Board. Pl go through it.
  • Also  HAZ Rules includes provisions to verify secured treatment/ storage/ disposal facility before granting authorisation.
  • Water Rules also includes the consent application form in which industry have to show its treatment scheme.
  • As per Water Act, SPCB has to verify industrial plant including treatment plants, get information about feasibility to achieve discharge norms…..’
  • As per rule 25 Water Act SPCB can grant consent with conditions:

“ any such conditions imposed shall be binding on any person establishing or taking any steps to establish any industry, operation or process, or treatment and disposal system or extension or addition thereto, or using the new or altered outlet, or discharging the effluent from the land or premises aforesaid; or  

 Like these ....the entire set of Acts/ Rules have to read thoroughly.

Have you gone through ever.... Each & every thing is written there...go by sections & subsections... you will get your answer.
