Just wanted to know, is there any indian law/Act that define SPILL or SPILLAGE reporting? Want to know legal definition of SPILL and SPILLAGE REPORTING.

Please guide in defining SPILL legally(as per indian legislation and as per international legislation)?

SPILL HAS NOT BEEN DEFINED UNDER THE GLOSSARY OF HWMTBM RULES PRESENTLY AND HENCE, IT SHOULD BE UNDERSTOOD AS PER THE AUDITOR'S ASSESSMENT ON THE SPOT.

iTHanks,but  is any other legislation (local)on protection of marine environment speaks about SPILL or SPILLAGE reporting?is there any international convention has defined it?

I can speak only of marine spills ///

International >> MARPOL 73/78

1)   On the event of a spill by a ship the Ship's Oil Pollution Emergency Plan (SOPEP) must be activated, as per MARPOL 73/78 requirements.  All ships of 400 GT and above must carry an oil prevention plan as per the norms and guidelines laid down by International Maritime Organization under MEPC (Marine Environmental Protection Committee) Act.

2) The National Oil Spill Disaster Contingency Plan (NOS-DCP) was proclaimed law by the Government of India in 1996, through the Coast Guard Act, to combat pollution arising from oil spillage. The Coast Guard was designated as Central Coordinating Authority for NOS-DCP.  India’s maritime ports were also made stakeholders in the plan to act independently or in co-ordination with the Coast Guard in an oil response scenario. 

Spill Response is based on the severity of the spill, and categorized into 3 Tiers..

Tier - 1 Small,
Up to 700 Tons
of oil spilled, Depending upon threat perception. >>> the Port should be able to handle it.

Tier - 2 Medium,
700 to 10,000 Tons of oil spilled.>>>> National Response Required,
under the Supervision of the Coast Guard

Tier - 3 Large,
Above 10,000 Tons.>>>>> Major Spill >>>
International Response Required >> Coast Guard will Work with International Agencies to contain and control the spill
