High Level Committee (HLC) to review five major Acts administered by Ministry of Environment, Forests & Climate Change - Comments solicited -- reg

A High Level Committee (HLC) has been constituted vide OM 22-15/2014-IA-III, dated 29.08.2014 to review the following Acts administered by Ministry of Environment, Forests & Climate Change:

  1. Environment (Protection) Act, 1986
  2. Forest (Conservation) Act, 1980
  3. Wildlife (Protection) Act, 1972
  4. The Water (Prevention and Control of Pollution) Act, 1974
  5. The Air (Prevention and Control of Pollution) Act, 1981
  6. The Indian Forest Act, 1927

EIA NOTIFICATION 2006

I)Electro plating industries was dropped(when Mr Raja was Env Minister) from the schedule which discharges eff containing heavy metals.Corporate industries are exploiting these polluting activity through tyny industries, still 100 of unis are in operation illegally in Delhi and as well inmany of the States like Tamilnadu,Panjab etc.It has to be brought back and regularised .The Govt may propose industrial estates exclusively for such kind of tyny units to control the pollution.It would not be viable for the tyny units to install ETP independantly.H sinceence there shall be total ban for such kind of units in small scale sector unless itis promoted as clusters in a industrial estates as suggested.

Categorisation

ii)For the purpose of Env Clearance,the industries are categorised as "A" and B.It may be categorised to A,B and C. Some of the category A Units such as Sugar mills,Thermal Power,High ways may be brought under Category B and present Category "B" may be broght under "C".entrusted to States for issue of EnV Clearance.

iii)TOR-For getting EC,Obtaining TOR may be withdrawn ,instead TOR may be standardised.

iv)On receipt of EIA Study Report,the Report shall be scrutinksed with in 30Days and on receipt of reply,the EC shall be issued with in 30days completing the exercise of presentation.

v)Presnting the EIA to the appraisal committee need not be followed for all Projects.Incase MOEF satisfies the Report,EC MAY BE ISSUED even with out presentation to appraisal committee.Later if necessary,EC may be amended with additional conditions.

Exemption from Water Act and AirAct

Non polluting Industries(GREEN) functioning in Industrial areas and in IndustrEstates shall be exepted from the above Acts

Geen category industries which provides employment for more than 50 people shall be supplied electricity at 50% subsidiesd cost.

These are some of mu suggestions to the HLC for review

It is observed that the main motive is to mainly relax Linear projects from EC.
